EPA will strongly encourage the use of electronic manifests as these manifests will be the easiest and least expensive way to manage the disposal of waste. Once e-Manifest becomes effective, States will have access to the manifest data in the e-Manifest system.

Benefits of the e-Manifest system include:

  • Cost savings
  • Accurate and more timely information on waste shipments
  • Rapid notification of discrepancies or other problems related to a particular shipment
  • Creation of a single hub for one-stop reporting of manifest data for use by EPA and states
  • Increased effectiveness of compliance monitoring of waste shipments by regulators; and
  • The potential for integrating manifest reporting with Resource Conservation and Recovery Act (RCRA) biennial reporting process and other federal and state information systems.

e-Manifest schedule and milestones

EPA expects to officially launch the e-Manifest system in June 2018. On this date, receiving facilities will begin submitting copies, whether electronic or paper, of the manifest to the EPA and will incur user fees. The e-Manifest requirements will become immediately effective in all states on the system launch date.

According to the EPA, there are approximately 215,000 industrial entities comprised of generators, transporters, and TSDFs, 33 state governments that will be impacted by the e-manifest implementation. There are approximately 3,300,000 hazardous waste manifests circulated annually.

User Fee Rule

The following table of fee estimates should be interpreted as rough approximations of the final fees. EPA will publish a final two-year schedule of user fees on the e-Manifest website, here , when more information about the e-Manifest budget and contracts awards becomes available. The fee estimates presented in the following table are per-manifest fees for each manifest submission type.

The final rule includes the following incentives to move from paper to electronic:

  • Differential fees (paper will cost more)
  • Pivot for higher fees for paper manifest, if electronic manifest use does not reach 75% in four years, and
  • Phase-out of facilities’ mailed paper submissions three years after system launch.

Users will not pay the same fee for manifests. Under the final rule’s fee methodology, users will pay differential fees, depending upon the type of manifest submitted. The e-Manifest user fees are required to accomplish full cost recovery, and EPA has concluded that some manifests will produce greater costs than others for the system to process. Fully electronic manifests will entail the least amount of processing and Quality Assurance (QA) related costs, while paper manifests will entail greater processing costs for data key entry and QA activities, depending upon the mode of submission (i.e., mail, data file upload, or image file) of paper manifest data to the system and thus will bear higher fees accordingly.

How will e-Manifest work

The e-Manifest system is being built as a module component of the existing Resource Conservation and Recovery Act Information System (RCRAInfo).

Once available in June 2018, e-Manifest will provide the stakeholders listed below with the following functions:

  • Generators and transporters of waste shipped on a manifest: Generators and transporters will be able to create, edit, and sign manifests and will be able to retrieve copies and status information on manifests. Transporters can also locate manifests created by generators that indicate they are the intended transporter.
  • Receiving facilities: Facilities receiving waste shipped on a manifest will be able to sign manifests when the waste is received, submit the manifests to EPA, make corrections to submitted manifests, and retrieve copies of manifests submitted within the past three years.
  • States and Tribes: State and tribal government users will be able to retrieve copies and status information on any manifests associated with entities in their state.

All users of the RCRAInfo Industry application can only act upon or in behalf of hazardous waste sites that they have been granted permissions. Once you have found and selected your sites of interest, you will be asked to request permissions for those sites. You can request individual permissions for each module in which the State where these sites are located participates.

In addition, there is a Site Management permission. A user with this permission has the ability to approve and grant permissions to other users requesting access to sites for which they have this permission. This permission also can do everything that a Certifier can do and also requires that the user obtain an Electronic Signature Agreement.

EPA e-manifest account

Handlers of hazardous waste (generators, or treatment, storage or disposal facilities) need to:

  1. Be registered to the RCRA Info system and have valid EPA IDs for each site they may assign to the e-Manifest system.
  2. Get the Generated keys from the EPA e-Manifest system and provide them into your EMS account.
  3. You are now ready to submit, edit, sign and print your manifests through the e-Manifest portal.
